ASSUMPTION OF RISK, WAIVER, AND RELEASE OF LIABILITY AGREEMENT
PLEASE READ CAREFULLY. THIS AGREEMENT AFFECTS YOUR LEGAL RIGHTS.
This Agreement is entered into between the undersigned participant (“Participant”) and Academia Brazilian Jiu Jitsu Inc., including its owners, directors, officers, employees, instructors, coaches, volunteers, independent contractors, visiting instructors, seminar guests, agents, and representatives (collectively, “Academia BJJ”).
If the Participant is under the age of 18, this Agreement must be signed by the Participant’s parent or legal guardian (“Guardian”), who agrees to all terms herein on behalf of themselves and the minor Participant.
1. ACKNOWLEDGEMENT OF INHERENT RISK
The Participant understands and acknowledges that Brazilian Jiu Jitsu, grappling, martial arts, fitness training, and related activities are inherently dangerous and involve significant risk of injury, including but not limited to:
- Physical contact with other participants
- Throws, takedowns, sweeps, and falls
- Joint locks, chokeholds, pressure, and submission techniques
- Muscle strains, sprains, fractures, dislocations
- Concussions, head and neck injuries
- Cuts, abrasions, and bruising
- Cardiac events or other serious medical conditions
- Transmission of illness or disease
- Permanent injury, paralysis, or death
The Participant understands that these risks may occur even when all safety precautions are taken.
2. ASSUMPTION OF RISK
The Participant freely and voluntarily assumes all risks, known and unknown, foreseeable and unforeseeable, associated with participation in any activity at or related to Academia BJJ.
This assumption of risk includes risks arising from the NEGLIGENCE of Academia BJJ or others, to the fullest extent permitted by law.
3. SCOPE OF ACTIVITIES COVERED
This Agreement applies to all activities, including but not limited to:
- Group classes and private lessons
- Open mats and sparring
- Seminars, workshops, and special events
- Instruction by visiting or guest instructors
- Strength, conditioning, or mobility training
- Use of mats, training equipment, weights, and facilities
- Time spent in change rooms, common areas, or surrounding premises
4. RELEASE AND WAIVER OF LIABILITY
The Participant, on behalf of themselves and their heirs, executors, administrators, and assigns, HEREBY RELEASES, WAIVES, AND DISCHARGES Academia BJJ from any and all claims, demands, actions, damages, or causes of action arising out of or related to participation in activities at Academia BJJ,
INCLUDING CLAIMS ARISING FROM THE NEGLIGENCE OF ACADEMIA BJJ
, to the fullest extent permitted by law.
This release applies to personal injury, property damage, emotional distress, or death, whether occurring on or off the premises.
5. INDEMNIFICATION AND HOLD HARMLESS
The Participant agrees to INDEMNIFY AND HOLD HARMLESS Academia BJJ from any and all claims, liabilities, damages, costs, or legal expenses (including legal fees) arising from:
- The Participant’s actions or omissions
- Violation of gym rules or instructions
- Injury to the Participant or others caused by the Participant
6. RULES, INSTRUCTION, AND SAFETY
The Participant agrees to:
- Follow all gym rules, policies, and safety instructions
- Acknowledge the authority of instructors and staff
- Conduct themselves in a respectful and safe manner
Academia BJJ reserves the right to deny participation or remove any Participant for unsafe conduct, failure to follow instructions, or behavior deemed inappropriate, without refund.
7. MEDICAL CONSENT AND RESPONSIBILITY
The Participant confirms they are physically and medically fit to participate.
The Participant authorizes Academia BJJ to obtain emergency medical treatment if deemed necessary and agrees to assume full financial responsibility for any medical care provided.
8. MINORS – PARENT OR GUARDIAN AGREEMENT
If the Participant is under 18 years of age, the Guardian:
- Consents to the minor’s participation
- Assumes all risks on behalf of the minor
- WAIVES AND RELEASES all claims on behalf of the minor
- AGREES TO INDEMNIFY Academia BJJ if any claim is brought by or on behalf of the minor
The Guardian acknowledges that this Agreement is binding on both the Guardian and the minor Participant.
9. NO GROSS NEGLIGENCE OR INTENTIONAL HARM
Nothing in this Agreement limits liability for gross negligence, reckless conduct, or intentional wrongdoing, where such limitation is prohibited by law.
10. GOVERNING LAW
This Agreement shall be governed by and interpreted in accordance with the laws of the Province of Ontario and the applicable laws of Canada.
11. SEVERABILITY
If any portion of this Agreement is held invalid or unenforceable, the remaining provisions shall continue in full force and effect.
12. ACKNOWLEDGEMENT AND SIGNATURE
The Participant (and Guardian, if applicable) acknowledges that they have read, understood, and voluntarily agreed to this Agreement, and understand that they are giving up substantial legal rights.
